Terms of Service
1. Acceptance of Terms
By using our agency's services, you agree to comply with and be bound by these Terms of Service, as well as comply with all applicable laws and regulations.
2. Services Provided
We enroll clients in health and life insurance products and related services regulated under state law and federal regulations, including enrollment assistance, policy servicing, and claims support. We may also provide communications regarding plan options, regulatory changes, and service notifications necessary to maintain your coverage.
3. Regulatory Compliance and Record Retention
In accordance with Florida state law and Centers for Medicare & Medicaid Services (CMS) requirements, we retain all information related to insurance enrollments and claims for a minimum of ten (10) years from the date of enrollment or last activity. This retention applies to all customer personal information, health data, and transaction records to comply with legal and regulatory obligations.
Retention Limitations: While we are required to maintain records for the periods mandated by law and regulation, clients should note that this retention requirement is non-negotiable and cannot be modified upon request. Records will not be deleted during the required retention period, as such deletion would violate federal and state compliance obligations and would prevent us from providing essential service support, claims assistance, and regulatory responses on your behalf.
Upon expiration of applicable retention periods, records will be securely destroyed consistent with industry standards and applicable law.
4. Information Accuracy
Clients agree to provide accurate, complete, and updated information as part of the enrollment and service process. Clients must understand that failure to provide accurate and complete information in a timely manner may cause them to be enrolled in a less than optimal plan, resulting in higher costs and/or lesser coverage.
5. Use of Information
We use your information solely to:

8. Limitation of Liability
Our agency will make reasonable efforts to provide accurate information and service; however, we are not liable for any indirect, incidental, or consequential damages arising from the use of our services or information provided.
9. Communication Preferences and Opt-Out Rights
Your Communication Choices: You have the right to control how we communicate with you regarding non-essential communications. You may opt out of certain communications, including but not limited to marketing materials, informational emails, and non-urgent notifications, while remaining enrolled in and receiving service for your insurance plan(s).
How to Opt Out: To opt out of non-essential communications, you may:

What You Cannot Opt Out Of: You cannot opt out of communications that are essential to maintain your coverage, including but not limited to:

Honoring Your Preferences: We will honor your opt-out request within ten (10) business days and will maintain a record of your communication preferences. You may change your communication preferences at any time by contacting our agency.
10. Changes to Terms
We reserve the right to modify these Terms of Service as required to comply with changes in law or business practices, with notification to clients as required by law. Continued use of our services following notification of changes constitutes acceptance of the modified terms.

Important Note on Retention: Federal and state regulations require us to maintain your records for specific periods to ensure we can provide ongoing service support, respond to claims issues, comply with regulatory audits, and fulfill legal obligations. We cannot delete or destroy your records during the required retention period, even upon your request, as doing so would violate regulatory requirements and compromise our ability to serve you and respond to claims or compliance inquiries.
Information retained solely to comply with legal requirements will not be used for any other purpose and will not be disclosed except as required by law or regulation.
6. Your Rights and Choices
Access and Correction: You have the right to access and request corrections to your personal information maintained by our agency. To exercise this right, contact our compliance officer with specific details about the information you wish to review or correct.

Limited Opt-Out Rights: While you may opt out of certain non-essential communications, you acknowledge that we must retain your personal information as required by law and that opting out of communications does not limit our ability or obligation to retain records as mandated by CMS and Florida regulations.

7. Reporting and Compliance

Response Timeline: We will respond to your requests within forty-five (45) days of receipt. If your request is complex or requires additional time to process, we may extend this timeline by an additional fifteen (15) days, and will notify you of the extension.

By engaging our services, you acknowledge that you have read and understood these Terms of Service and Privacy Policy, including the information regarding record retention requirements, limitation of data deletion, communication opt-out rights, and your privacy rights under Florida and federal law.
